Terms of Service

By accessing or using BodhX AI, you agree to these Terms of Service. If you are using the platform on behalf of a company, partnership, proprietorship, startup, or other organization, you represent that you have authority to bind that entity to these terms.

If you do not agree to these terms, you should not access or use the service.

BodhX AI is a software platform that helps businesses create and operate AI agents, organize business knowledge, connect customer communication channels, automate workflows, monitor conversations, and manage related business operations.

We may add, remove, modify, or improve features from time to time. Some features may be subject to plan limits, usage caps, beta terms, or additional product-specific conditions.

You are responsible for maintaining the confidentiality of your login credentials, team access, connected channel permissions, API tokens, and any actions taken through your account or workspace.

You must provide accurate registration and billing information and keep it updated. You agree to notify us promptly if you become aware of unauthorized access or security concerns affecting your account.

You retain ownership of the data, content, documents, websites, prompts, media, contacts, and messages that you or your users submit to BodhX AI.

You grant BodhX AI the limited rights necessary to host, process, transmit, analyze, display, and use that content solely to operate, secure, support, and improve the service for your workspace.

You confirm that you have all rights, permissions, notices, and lawful bases required to use that content with BodhX AI and with any connected communication channels or integrations.

BodhX AI may generate replies, drafts, summaries, suggestions, prompts, classifications, workflow recommendations, and automated actions. These outputs are probabilistic and may not always be accurate, complete, or appropriate for your specific business context.

You are responsible for reviewing, approving, supervising, and monitoring outputs and automations where appropriate, especially for customer communication, legal, financial, healthcare, regulated, or high-impact decisions.

BodhX AI is a business software tool and not a law firm, accounting firm, regulated advisory provider, or emergency response service.

Your use of WhatsApp, Meta, Instagram, Google, telephony, payment, CRM, spreadsheet, and other third-party services remains subject to those providers' own terms, policies, API restrictions, approval requirements, and platform limits.

BodhX AI is not responsible for downtime, rejection, suspension, account limitation, policy enforcement, or data handling performed by third-party platforms. You are responsible for maintaining your own standing with those providers.

Certain features may require a paid subscription, usage-based fee, setup fee, or other commercial arrangement. You agree to pay all applicable charges in accordance with your selected plan or order terms.

Unless otherwise stated, fees are non-refundable except where required by applicable law or expressly agreed by us in writing. You are responsible for applicable taxes, duties, levies, or similar governmental charges, including GST where applicable.

You may not use BodhX AI to violate law, infringe intellectual property or privacy rights, send unlawful marketing messages, distribute spam, impersonate any person, mislead customers, deploy harmful or deceptive automations, or interfere with the operation or security of the platform.

You may not attempt unauthorized access, reverse engineer restricted systems except where legally permitted, overload the service, or use BodhX AI in ways that could expose us, our customers, or third parties to legal or reputational harm.

We may suspend, restrict, or terminate access to the service if we reasonably believe there is non-payment, misuse, fraud, security risk, legal exposure, excessive abuse, third-party platform policy violations, or a material breach of these terms.

You may stop using the service at any time. Termination does not relieve you of obligations accrued before the termination date, including payment obligations.

Each party may receive confidential information from the other in connection with the service. The receiving party agrees to use confidential information only for the purpose of performing under these terms and to protect it using reasonable care.

This section does not apply to information that is publicly available without breach, already known without restriction, independently developed, or lawfully received from another source.

BodhX AI is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free performance.

We do not guarantee that the service will always be available, that integrations will remain supported forever, or that AI outputs will meet every business requirement without human review.

To the maximum extent permitted by law, BodhX AI and its affiliates, founders, employees, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, goodwill, data, business opportunities, or anticipated savings arising out of or related to the service.

To the extent liability cannot be excluded, our aggregate liability arising from or relating to the service will not exceed the amounts paid by you to BodhX AI for the relevant service during the three months preceding the event giving rise to the claim.

These terms are governed by the laws of India, without regard to conflict of law principles. Subject to applicable law, courts located in New Delhi, India will have exclusive jurisdiction over disputes arising out of or relating to these terms or the service.

Before initiating formal proceedings, both parties agree to make a good-faith effort to resolve disputes through written notice and discussion.

We may update these Terms of Service from time to time. If we make material changes, we may update the effective date and provide notice through the website, dashboard, or email where appropriate. Your continued use of the service after the updated terms become effective constitutes acceptance of the revised terms.
